Neutral Citation No. - 2025:AHC-LKO:24819-DB Court No. - 2 Case :- WRIT - C No. - 4176 of 2025 Petitioner :- Ved Prakash Yadav Respondent :- State Of U.P. Thru. Addl. Chief Secy. Revenue Lko. And 9 Others Counsel for Petitioner :- Krishan Kanhaya Pal,Pooja Pal Counsel for Respondent :- C.S.C. Hon'ble Rajan Roy,J. Hon'ble Om Prakash Shukla,J.
1. Heard Mr. Krishan Kanhaya Pal, learned counsel for the petitioner and learned standing counsel for the State.
2. Admittedly, the proceedings under Section 229 of the U.P. Zamindari Abolition and Land Reforms Act, 1950 at the behest of the petitioner were dismissed. The appeal against it was also dismissed. A writ petition has been filed in this Court challenging the said orders bearing Writ C No. 1010 of 2020 wherein there is no interim order. The petitioner is not recorded as of now in the Khatauni in respect of Gata No. 2016 and 2046. In the proceedings for correction of map initiated by the opposite party no. 9 objections were filed by the petitioner which have been rejected and some appeal is pending at the behest of the petitioner.
3. In this scenario, we fail to understand as to how a writ petition is maintainable at the petitioner's behest. Whatever pleas the petitioner wants to raise he can raise it in the writ petition which is already pending or in the appeal which may be pending before the revenue Courts.
4. The writ petition is disposed of accordingly. [Om Prakash Shukla, J.] [Rajan Roy, J.] Order Date :- 30.4.2025 Santosh/- Digitally signed by :- SANTOSH KUMAR High Court of Judicature at Allahabad, Lucknow Bench
