Neutral Citation No. - 2025:AHC-LKO:25561 Court No. - 18 Case :- WRIT - A No. - 4850 of 2025 Petitioner :- Mamta Devi Respondent :- State Of U.P. Thru. Secy. Child Development Nutrition Govt. Of U.P. Lko. And 5 Others Counsel for Petitioner :- Rajat Pratap Singh,Prashant Singh Chauhan Counsel for Respondent :- C.S.C. Hon'ble Karunesh Singh Pawar,J. In view of the proposed order being passed, notices to respondent No.6 is dispensed with. Written instructions provided by learned standing counsel are taken on record. Heard learned counsel for the petitioner and learned standing counsel for the State-respondent. Submission of learned counsel for the petitioner is that the respondent No.6 has wrongly been considered as a BPL category candidate and selected although the ration card of respondent No.6 has been issued after the date of the advertisement. The ration card was issued on 02.11.2024 which is much after the date of the advertisement i.e. on 18.02.2024 and, therefore, the respondent could not have been selected on the basis of her having BPL category. Learned standing counsel has opposed the contention on the basis of written instructions. A perusal of the instructions shows that one Rubi Devi has been selected on the post of Anganwadi Karyakarti who is a widow belonging to BPL category. On the contrary, the petitioner though as a BPL category candidate however, is not a widow therefore, comes at third place in the priority list and hence the respondent No.6 being widow as well as BPL category candidate has been selected in terms of the Government Order dated 21.03.2023 Clause-III, paragraph Ga-1. It has also been submitted that the selected candidate has been appointed vide order dated 17.03.2025 and has joined on the centre on 20.03.2025 thus, from the instructions it is clear that selected candidate is a widow as well
as BPL category candidate hence has been given first priority in the selection accordingly, there appears to be no illegality in the selection of the respondent No.6 as well as her appointment, petition being devoid of merits and is accordingly dismissed.
