Learned senior counsel appearing for the petitioner submits that the allegation against the petitioner is that the petitioner committed rape upon a lady under 16 years to age and also committed penetrative sexual assault upon her. It is submitted that the allegation against the petitioner is false. Drawing attention of the court to the statement of the victim, recorded under Section 180 of BNSS, it is submitted by the learned senior counsel for the petitioner, that the victim has categorically stated that the petitioner took her inside the Scorpio vehicle and made her drink some liquid and she went under intoxication, but she does not know as to what happened thereafter with her and the petitioner dropped her at some distance from her hostel and fled away. It is next submitted that as per the medical examination report there is no injury found in and around the vagina of the victim. It is next submitted that the petitioner has no
criminal antecedent, as mentioned in paragraph 14 of the bail application. It is next submitted that the petitioner has been in jail custody since 04.04.2025, as mentioned in para 15 of this bail application. It is next submitted by learned counsel for the petitioner that the charge sheet has already been submitted in this case and the petitioner is ready and willing to co-operate with the trial of the case hence, the petitioner may be admitted to regular bail. Learned Addl. P.P. opposed the prayer for regular bail . Considering submissions of learned counsels and the facts as stated above, I am inclined to release the petitioner on bail. Hence, the court below is directed to release the petitioner on bail on furnishing bail bond of Rs.
25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, POCSO, Palamau in connection with Pipra P.
