Neutral Citation No. - 2025:AHC-LKO:25346 Court No. - 18 Case :- WRIT - A No. - 4842 of 2025 Petitioner :- Nandini Singh Respondent :- State Of U.P. Thru. Addl. Chief Secy. Deptt. Bal Vikas Sewa Evam Pushtahar Lko. And And 5 Others Counsel for Petitioner :- Alok Kr. Misra Counsel for Respondent :- C.S.C. Hon'ble Karunesh Singh Pawar,J. The written instructions provided by the learned standing counsel are taken on record. Heard learned counsel for the petitioner and learned standing counsel for the State-respondents. By this petition, the petitioner has prayed for the following reliefs:- "i) Issue writ order or direction in the nature of certiorari for quashing the impugned selection list in respect of opposite party No. 6 whereby she selected against the post of Aanganwadi Worker for Village Matiyariya Imiliya, District Balrampur, contained as Annexure No. 1, in the interest of justice. ii) Issue writ order or direction in the nature of in the nature of mandamus commanding the concerned opposite parties that they consider the case of petitioner and appoint the petitioner on the post of Aanganwadi worker of Village Matiyariya Imiliya, District Balrampur within reasonable time, in the interest of justice." Learned counsel for the petitioner submits that respondent No.6 as well as the petitioner both have applied for the post of Anganwadi Karyakarti. The respondent No.6 was issued two income certificates, first dated 28.10.2024 and second was of 11.11.2024. The second income certificate dated 11.11.2024 was issued fraudulently on misrepresentation of respondent No.6 therefore, the complaint was made by the petitioner and on that complaint that certificate has been cancelled by the district authority. He submits that petitioner is a widow however, the respondent No.6 in spite of cancellation of her BPL certificate has been selected although she is above poverty line category candidate. Learned standing counsel has denied the contention made by learned counsel for the petitioner and has stated that after cancellation of the income certificate of respondent No.6 she has not been selected. The case of the petitioner is under active consideration for selection on the post of Anganwadi Karyakarti. In paragraph 4 of the written instructions, it has been mentioned that petitioner had also applied for the vacant post under APL category as widow and, therefore, she has been selected on second priority. Learned standing counsel submits that after cancellation of the case of respondent No.6, the candidate who is in the second priority shall be selected after due approval from the District Magistrate. In view of aforesaid statement, it is evident that writ petition has been filed on misconceived facts, the case of the petitioner is already under consideration for selection as per the written instructions provided by the learned standing counsel. It is needless to say that opposite parties will adhere strictly in accordance with the policy of the government as provided under the Government Order dated 21.03.2023 as stated in the written instructions. Accordingly, the writ petition is disposed of. Order Date :- 2.5.2025 Saurabh Yadav/- Digitally signed by :- SAURABH YADAV High Court of Judicature at Allahabad, Lucknow Bench
