Neutral Citation No. - 2025:AHC-LKO:25454 Court No. - 6 Case :- WRIT - C No. - 4198 of 2025 Petitioner :- Ram Prasad And 3 Others Respondent :- State Of U.P. Thru. Prin. Secy. Home Lko. And 6 Others Counsel for Petitioner :- Kaushal Kishore Tewari,Shakti Counsel for Respondent :- C.S.C. Hon'ble Pankaj Bhatia,J.
1. Heard learned Counsel for the petitioner and learned Standing Counsel.
2. The present petition has been filed challenging an order dated 05.12.2024 whereby, the Gram Nyayalay, Sitapur has dismissed the suit filed by the petitioner.
3. A perusal of the record reveals that the petitioner was using the land in question allegedly for storing the fertilizer. The said land does not belong to the petitioner or any other relief on the basis of adverse possession etc. was pleaded. The only allegation is that the respondents are trying to encroach the said property.
4. As per the argument, the said property, on which the fertilizers are stored, are belong to the Gram Sabha
5. The court consider the relevant material that was placed and framed as many as three issues. While deciding the Issues no.1 to 3, the court had held that the plaintiff could not establish either the title or any declaration was sought. In view thereof, the suit was dismissed. Even before this Court, there is no material to suggest any interest vested in the petitioner over the land in question, as such, I do not find any error in the order impugned.
6. The writ petition lacks merit and is dismissed. Order Date :- 2.5.2025 akverma Digitally signed by :- ASHOK KUMAR VERMA High Court of Judicature at Allahabad, Lucknow Bench
