Neutral Citation No. - 2025:AHC-LKO:25712 Court No. - 8 Case :- CONTEMPT APPLICATION (CIVIL) No. - 1352 of 2025 Applicant :- Susheel Prasad Pathak Opposite Party :- Swetabh Singh Tehsildar (Judicial), Patti. Distt. Pratapgarh Counsel for Applicant :- Sunil Kumar Singh,Vishwa Mohan Tiwari Hon'ble Jaspreet Singh,J. Heard learned counsel for the petitioner. The instant petition under Section 12 of the Contempt of Court Act has been preferred by the petitioner seeking issuance of notice to the respondent for willful disobedience of the order dated 22.10.2024 passed by the writ Court in Matters Under Article 227 No.5004/2024. Having considered the submissions of the learned counsel for the petitioner and perusal of the order dated 22.10.2024, it would indicate that the Court had requested the respondent to decide the case of the petitioner preferably within a period of four months from the date a certified copy of the order passed is placed before the Court concerned. The said order also indicates that the petitioner was required to furnish an undertaking with the clear averments that in case if the aforesaid was not furnished, the petitioner shall not be entitled to the benefit of the order. Admittedly, the petitioner has not furnished the undertaking before the Court concerned. For the aforesaid reasons, the petitioner is not entitled to the benefit of the order. No case for contempt is made out. Accordingly, the contempt application is dismissed.
