The case is put up before the National Lok Adalat. The matter is amicably settled between the parties. The claimants, herein, and the appellants United India Insurance Company Limited, represented by Mr. Swapan Maji, RM, are present before the Court today. The parties are represented by Mr. A. Kakati, and Mr. A. N. Iqbal. It is stated at the Bar that the claimants No. 4 & 5(parents of the deceased), have already passed away prior to passing of the award, dated 03.03.2025, by the Motor Accident Claim Tribunal, Kamrup(M), Guwahati. Accordingly, the compensation involved in the matter, is directed to be disbursed in favour of the claimants No. 1, 2 & 3, only. It is submitted by both the claimants and the Insurance Company’s representatives that this matter is settled between the parties at an amount of Rs. 42,00,000/-, inclusive of all components as a full and final settlement of the claim. The Insurance Company will deposit the said amount of Rs. 42,00,000/- within a period of 45 days from today before the Registry of the Gauhati High

Failure to deposit the above-noted amount within the stipulated time by the Insurance Company, the above amount would carry an interest @ 7% from the date of filing of the claim petition before the learned Tribunal. The total deposited amount of Rs. 42,00,000/-, shall be released in the following manner:
(i). An amount of Rs. 5,00,000/-, each, shall be released and kept in the Fixed Deposit Accounts in the names of claimant No. 2 viz. Sri Angkit Nandi; and claimant No. 3 viz. Sri Rushan Nandi; respectively, before a nationalized Bank/Post Office till they attain the age of majority; (ii). An amount of Rs. 5,00,000/-, shall be released and kept in the Fixed Deposit Account in the name of claimant No. 1 viz. Smti. Dip Mala Nandi, for a period of 5 years. (iii). The balance amount of Rs. 27,00,000/- shall be released to the claimant No. 1 viz. Smti. Dip Mala Nandi; by the Registry of the Gauhati High Court upon furnishing of adequate documents for her identification as well as the particulars of her Bank Account. Statutory Deposit, if any, made by the Insurance Company being not a part of the amount so settled today; the same be released to the Insurance Company on an application made by it in this connection. The appeal, accordingly, stands disposed of in terms of the amicable settlement reached between the parties. The compromise format signed by the parties is kept on record. Page No.# 4/4 LCRs, if any, be remitted to the concerned learned Tribunal. JUDGE
