Present Writ Petition has been filed under Article 226 of the Constitution of India with the following prayers:- “(i) Issue a writ, order or direction in the nature of certiorari quashing the order dated 01.07.2024 passed by respondent No.3/District Magistrate, Dehradun (Annexure No.1) whereby 19 persons have been identified as affected people of the naturally calamity of landslide in village Madarsu (Jakhan), tehsil Vikasnagar, District Dehradun and have been considered for allotment of land in village Rudrapur, Tehsil Vikasnagar, District Dehradun. (ii) Issue a writ, order or direction in the 1 2025:UHC:661 nature of Mandamus be issued directing the District Magistrate Dehradun to restore back possession of land allotted vide order dated 01.07.2024, to private respondent, of Village Panchayat Rudrapur Tehsil Vikas Nagar, District Dehradun are not to interfere in its possession. (iii) Award the cost of petition to the petitioner.” 2. Heard Mr. Arvind Vashistha, learned Senior Advocate assisted by Mr. Hemant Singh Mehra, learned counsel for petitioner and Mr. Suyash Pant, learned Standing Counsel for respondents. 3. Mr. Arvind Vashistha, learned Senior Advocate, has submitted that a revision against the order dated 01.07.2024 and the consequential proceedings, passed by the District Magistrate, Dehradun, the respondent no.3, has been filed by the petitioner before the Board of Revenue. Therefore, on instruction, Mr. Arvind Vashistha, learned Senior Advocate, has requested to permit the petitioner to withdraw the present writ petition to pursue the said revision. 4.
