Secy. Home U.P. Lko. Counsel for Applicant :- Pawan Kumar Singh Counsel for Opposite Party :- G.A. Hon'ble Shree Prakash Singh,J. 1. Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record. 2. The instant bail application has been filed on behalf of the applicant, Vimal Kumar Pandey @ Bose with a prayer to release him on bail during the trial in Case Crime No.25 of 2025, under Sections 303(2), 317(2), 316(5), 61(2) B.N.S. and Sections 26, 41, 42, 52 Indian Forest Act and Sections 27, 29, 31 and 51 of Wild Life Protection Act, Police Station Tulsipur, District Balrampur. 3. As per the prosecution story, the incident is said to have taken place on 28.01.2025 at about 04:00 AM, when an S.S.B. team alongwith staf intercepted one pickup and one scorpio and recovered forest produce including wood from the seized vehicle. 4. It is submitted by learned counsel for the applicant that the applicant is innocent and he has falsely been implicated in the present case. He submits that the applicant is not named in the first information report and he was also not apprehended on the spot. Further submission is that the applicant has been taken into custody only on the basis of call details with ranger. He further submits that the applicant is languishing in jail since 18.03.2025, who has previously criminal history of ten cases, which have sufficiently been explained by him. He added that identically situated co-accused, Suhel Ahmad @ Suhel Mistry has already been enlarged on bail in Criminal Misc. Bail Application No.3581 of 2025 and he is seeking parity to the same. Thus, submission is that the applicant may be enlarged on bail. In case the applicant is enlarged on bail, he will not misuse the liberty and will co-operate in the trial proceedings. 5. On the other hand, learned A.G.A. for the State has opposed the contentions aforesaid. However, he could not dispute the fact that identically situated co-accused, Suhel Ahmad @ Suhel Mistry has already been enlarged on bail. 6. Having heard the learned counsel for the parties and after perusal of record, it transpires that the applicant is not named in the first information report and even the accused persons, who were named in the first information report, have already been enlarged on bail. Identically situated co-accused, Suhel Ahmad @ Suhel Mistry has also already been enlarged on bail. The applicant is languishing in jail since 18.03.2025, who has previously criminal history of ten cases, which have sufficiently been explained by him. There is no possibility of conclusion of trial in near future and he has undertaken that he will not misuse the liberty of bail if granted and would co- operate in the trial proceedings. 7. Considering the submissions of learned counsel of both sides, nature of accusation and severity of punishment in case of conviction, nature of supporting evidence, prima facie satisfaction of the Court in support of the charge, reformative theory of punishment and considering larger mandate of the Article 21 of the Constitution of India and, without expressing any view on the merits of the case, I find it to be a case of bail. 8. Let the applicant, Vimal Kumar Pandey @ Bose involved in the aforementioned crime be released on bail, on his furnishing a personal bond and two sureties in the like amount, to the satisfaction of the court concerned, with the following conditions:- (i) The applicant shall not tamper with the prosecution evidence by intimidating/ pressurizing the witnesses, or otherwise during the investigation or trial; (ii) The applicant shall file an undertaking to the efect that he shall not seek any adjournment on the dates fixed for evidence when the witnesses are present in court. The identity, status and residential proof of sureties will be verified by the court concerned and in case of breach of any of the above conditions, the court below shall be at liberty to cancel the bail and send the applicant to prison. 10.
