Also heard Ms. N. Das, the learned Additional Public Prosecutor, Assam. 2. Both these bail applications has been filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita(BNSS), 2023, in respect of Bongaigaon P.S. Case No. 121/2025. 3. The petitioner Paban Sarma is the Manager of Wings Unisex SPA and Parlour at North Bongaigaon. The other petitioner Pradip Shill is the owner Page No.# 3/4 of the said beauty parlour. Another petitioner Anisha Ray@Anisha Barman is a woman, who is also the co-owner of the said beauty parlour. 4. On 17.05.2025, the police raided the said beauty parlour on an allegation that in the said beauty parlour a brothel was being run by some people. Some persons, namely, Ohidul Islam @Rahul was also caught red handed, while indulging in immoral acts. One girl named Senti Sangma was also apprehended in that manner. 5. The present three petitioners, namely, Paban Sarma has already spent 31 days in judicial custody, whereas, the petitioners, Pradip Shill and Anisha Ray@Anisha Barman have spent 21 days in judicial custody. 6. Ms. Das has objected to this bail application on the ground that the investigation of the case is still going on. 7. I have given my anxious considerations to the submissions made by the learned counsel of both sides. 8. Under the given circumstances, this Court is of the opinion that the period of detention already undergone by the petitioners should be taken as a ground for releasing them on bail. 9. Accordingly, both the bail applications are allowed. 10. The petitioners, Paban Sarma, Pradip Shill and Anisha Ray@Anisha Barman shall be released on bail of Rs. 25,000/- each with sureties of like amount to the satisfaction of the Court of the learned Chief Judicial Magistrate, Bongaigaon. 11. With the aforesaid directions, both the bail applications are disposed of accordingly Page No.# 4/4 12. Case Diary shall be returned. JUDGE Comparing Assistant
