Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor appearing for the State. 2. The learned counsel for the petitioner submits that the petitioner was arraigned as accused in Crime No.167 of 2024 of Pachipenta Police Station, Parvathipuram Manyam District, registered for the offence under Section 318(4) of the Bharatiya Nyaya Sanhita, 2023, on the strength of the complaint of the 2nd respondent. 3. It is alleged in the complaint that the petitioner collected money from the 2nd respondent by deceiving her into believing that he would secure a job for her grand-daughter in the Food Corporation and Health Departments. 4. The learned counsel for the petitioner submits that the allegations made in the complaint are baseless, and the petitioner has been falsely implicated in the present crime.The learned counsel further submits that the offences alleged against the petitioners are punishable below 7 years and, therefore, seeks a direction to the police to follow the procedure provided under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023. 5. Considering the submissions of the learned counsel for the petitioners, the Station House Officer, Pachipenta Police Station, Parvathipuram 3 CRL.P. No.3629_2025 Manyam District, is directed to follow the procedure as contemplated under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023, insofar as the petitioners are concerned, for the purpose of investigation in connection with Crime No.167 of 2024. This order would not preclude the investigation officer to file charge sheet or final report after completion of the investigation. 6. Accordingly, the criminal petition is disposed off. 7.
