Neutral Citation No. - 2025:AHC-LKO:25305 Court No. - 18 Case :- WRIT - A No. - 4802 of 2025 Petitioner :- Radhey Raman Singh Respondent :- State Of U.P. Thru. Prin. Secy. Deptt. Of Home Lko. And 3 Others Counsel for Petitioner :- Mayankar Singh,Ram Krishna Pratap Singh Counsel for Respondent :- C.S.C. Hon'ble Karunesh Singh Pawar,J. Heard learned counsel for the petitioner and learned Standing counsel for the respondents. By means of this petition, the petitioner has challenged the impugned order, annexed as Annexure No. 1 to the petition, whereby a recovery of Rs. 90,900/- has been directed against him for not vacating the government accommodation, House No. 177, Type-1, beyond the prescribed period. A perusal of the impugned order shows that the petitioner was transferred from PAC to District Gonda on 26.08.2020. Thereafter, he sought six months’ time to vacate the house, which was duly granted. Despite the expiry of this period, the petitioner continued to reside in the government accommodation unauthorizedly for approximately three years and nine months, although he was required to vacate the premises by 25.03.2021. Even after issuance of three notices, he failed to vacate the house. Consequently, the authorities have imposed normal as well as penal rent in accordance with the applicable rules and relevant office orders. There appears to be no illegality in the order impugned. The petition is devoid of merits and is accordingly dismissed. Order Date :- 2.5.2025/R.C. Digitally signed by :- RAM CHANDER YADAV High Court of Judicature at Allahabad, Lucknow Bench
