THE HON’BLE SRI JUSTICE HARINATH.N CRIMINAL PETITION No.3611 OF 2025 ORDER:
1. Heard the learned counsel for the petitioners and the learned Assistant Public Prosecutor appearing for the State.
2. The learned counsel for the petitioner submits that the petitioners were arraigned as A.1 to A.11 and A.13 to A.32 in Crime No.53 of 2025 of Phirangipuram Police Station, Guntur District, registered for the alleged offence under Sections 132, 121(1), 118(1), 126(2), 324(3) read with 190 of Bharatiya Nyaya Sanhita, 2023 and Section 3 of the Prevention of Damage to Public Property Act,
1984.
3. It is alleged in the complaint that the petitioners formed an unlawful assembly, assaulted the C.I. and damaged police vehicles and other property.
4. The leaned counsel further submitted that there are no specific allegations against the petitioners.The learned counsel further submits that the offences alleged against the petitioners are punishable below 7 years and, therefore, seeks a direction to the police to follow the procedure provided under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

Considering the submissions of the learned counsel for the petitioner, the Station House Officer, Phirangipuram Police Station, Guntur District, is directed to follow the procedure as contemplated under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023 for the purpose of investigation in connection with Crime No.53 of 2025. This order would not preclude the investigation officer to file a charge sheet or final report after completion of the investigation.
6. Accordingly, the criminal petition is disposed off.
