1. Heard learned counsel for the petitioners and learned Standing Counsel for the State.
2. By means of the present writ petition, the petitioners have prayed for a writ of mandamus commanding the opposite parties to release the financial aid under the Pradhan Mantri Awaas Yojana–Gramin (PMAY-G) as their names were included in the list of beneficiaries prepared as per norms.
3. The petitioner has placed on record the sanction certificates of three benefeciaries as well as the report, according to which, their case for the purposes of grant of benefit was vitrified on 27.12.2019.
4. Learned Standing Counsel on the basis of the instructions has stated that the at a later point of time the eligibility of the petitioners no. 1 to 3 for grant of the financial benefit under the scheme was found doubtful and it is for this reason that the fund could not be released in favour of the petitioner nos. 1 to 3, whereas, petitioner no. 4 was found eligible.
5. These are the disputed questions of fact which can be
looked into by the district authority.
6. We accordingly permit the petitioner to make a representation ventilating his grievance before the district magistrate concerned who after taking into account the documents filed by the petitioner as well as the report available, if any, shall pass a reasoned and speaking
order expeditiously and preferably within a period of one month from the date of filing the representation along with the relevant documents.
7. The writ petition is accordingly disposed of. . [Ajai Kumar Srivastava-I,J.] [Attau Rahman Masoodi, J.]
