IN THE HIGH COURT OF HIMACHAL PRADESH, SHIMLA CWP No.2793 of 2019 Decided on: 27.03.2025 Vidya Chand … Petitioner Versus State of Himachal Pradesh and others … Respondents Coram Hon’ble Mr. Justice Ajay Mohan Goel, Judge. Whether approved for reporting?1 ____________________________________________________ For the petitioner : Ms. Ranjana Chauhan, Advocate. For the respondents : Mr. Rajpal Thakur, Additional Advocate General. Ajay Mohan Goel, Judge (Oral) By way of this writ petition, the petitioner has prayed for the following reliefs:- (i) “That the respondent Nos. 1 to 4 may kindly be directed not to cancel the notification dated 01.09.2016 in respect of the creation of Temple Trust of Sh. Kasumba Bhavani Temple Trust Khegsu Tehsil Anni, District Kullu by de notifying the Temple Trust. (ii) That the respondents may also be directed not to terminate the appointment of petitioner as a Kardar of Sh. Kasumba Bhavani Temple Trust, Khegsu Tehsil Anni, District Kullu.” 2. A perusal of the record demonstrates that the writ petition was filed on 01.10.2019, whereas, in terms of notification dated 17.09.2018, copy whereof is appended as Annexure R-2 with the reply filed by the State, the entry qua the temple in issue being omitted from Schedule-1 of the Act was already in existence, therefore, it was this notification, which ought to have been assailed by the petitioner. 1 Whether reporters of the local papers may be allowed to see the judgment? 2 3. At this stage, learned counsel for the petitioner prays that the petitioner be allowed to withdraw this writ petition with liberty to file a fresh writ assailing the notification. 4. Accordingly, the petition is allowed to be withdrawn with liberty, as prayed for. (Ajay Mohan Goel) Judge March 27, 2025 (Vinod)
