PUBLIC PROSECUTOR The Court made the following: ORDER:- This Criminal Petition, under Sections 480 and 483 of the BNSS, has been filed by the petitioners/A3 and A4, seeking regular bail, in Crime No.10 of 2025 of Rajupalem Police Station, Kadapa District. 2. A case has been registered against the petitioners/A3 and A4 herein and others for the offences punishable under Sections 118(1), 79, 115(2) r/w 3(5) of Bharatiya Nyaya Sanhita, 2023. 2 3. The brief facts of the case are that on 14.01.2025 at about 5.10 a.m., at Daddanala Village, Rajupalem Mandal, due to the ill-feelings existing between complainant’s people and accused people regarding sprinkling water in front of their houses and cleaning buffaloes on the road, A1/Juvenile-in-conflict-with-law abused and went upon the husband of the defacto complainant while he was grumbling and when complainant tried to pacify the issue, A1 beat her with a stick and caused bleeding injury, then A2 to A4 joined him, A3 shouted loudly by directing his wife i.e., A2 and his two sons i.e., A1 and A4 to caught hold her rightly to kill her. As per the directions of A3, A1, A3 and A4 caught hold her tightly, A3 dealt a blow on her head to end her, and meantime, nearby persons rushed there and saved defacto complainant from the clutches of the accused and juvenile in conflict-with-law. Then, a case has been registered by the SI of Police, Rajupalem Police Station for the offence under Section 109, 118(1), 79, 115(2) r/w 3(5) of BNS. A3 and A4 were arrested and remanded to judicial custody on 03.03.2025. 4. Heard. Perused the record. 3 5. Learned counsel for the petitioners submits that A1 and A2 have been granted anticipatory bail, and except for the allegations that the petitioners beat the victim and others with hands and legs, no specific attributions have been made to attract Section 109 of BNS. The learned Assistant Public Prosecutor has not disputed the said fact. As per the record, the 2nd petitioner/A4 is aged about 21 years, and the petitioners/A3 and A4 are permanent residents of Daddanala Village, YSR Kadapa District. When ascertained the learned Assistant Public Prosecutor confirmed that the petitioners have no antecedents. As the petitioners have permanent abode at Daddanala Village, YSR Kadapa District, and there is no possibility of their fleeing away from the Jurisdiction of the Court. Considering the nature of the accusations and the fact that A1 and A2 have already been released on bail pursuant to the orders of the Court below in Crl.M.P.No.88 of 2025, dated 10.03.2025, this Court is inclined to grant bail to the petitioners with the following conditions. (i) The petitioners/A3 and A4 shall be released on executing a personal bond for Rs.25,000/- (Rupees twenty five 4 thousand only) each with two sureties for a like sum each to the satisfaction of the learned II Additional Judicial Magistrate of First Class, Proddatur. (ii) After release, the petitioners shall appear before the Station House Officer concerned on every Sunday between 10.00 a.m., and 1.00 p.m. for a period of two months. (iii) Further, the petitioners are directed not to hamper the investigation and tamper with the prosecution witnesses. 7. Accordingly, the Criminal Petition is allowed. _____________________ T.
