Heard Shri Anand Pal Singh, learned counsel for the petitioners, Shri Hemant Kumar Pandey, learned Standing Counsel for the State/opposite party No.1 as well as Dr. Pooja Singh, who has filed her Vakalatnama on behalf of opposite party No.2 and perused the record. 2. The instant petition has been preferred seeking following main relief:- "i.) Issue a writ, order or direction in the nature of Certiorari quashing the impugned order dated 21.01.2025 passed by opposite party no.1. (Annexure No. 1)." 3. Vide the impugned order dated 21.01.2025, which is quoted below, passed in Reference No.511/202454042300000864 (Narendra Dev Agricultural & Technical University Vs. State of U.P.) the opposite party No.1/Deputy Director of Consolidation, Ayodhya allowed the application for impleadment filed by the petitioner Shiv Mohan Singh and stayed the operation and implementation of the order dated 21.01.2023, passed by the Consolidation Officer whereby the Consolidation Officer, Milkipur, Ayodhya corrected/amended the final order dated 20.01.2023 passed in Common Case No.644, 645, 805, 806 of 2023 under Section 9-A (2) of the U.P. Consolidation of Holdings Act, 1953 (in short "Act of 1953"). For ready reference, impugned order dated 21.01.2025 is extracted herein under :- "21.01.25 प्रस्तुतकार द्वारा पत्रावली प्रस्तुत की गई। पुकार कराई गई। पक्षगण उपस्थिस्त आये। अरूण कु मार सिंह एवं रामकृ पाल सिंह की ओर े प्रा%ना पत्र बावत पक्ष बनाये जाने दि*नांक 2 09.01.25 ता स्गन प्रा%ना पत्र म्पत्ति- अधि/कारी आचाय% नरेंद्र *ेव कृ दि3 एवं प्रौद्योदिगक दिवश्वदिवद्यालय दि*नांक 21.01.25 पर ुना गया। एवं पत्रावली का म्यक अवलोकन दिकया गया। न्यायदिहत में उक्त स्गन प्रा%ना पत्र ता उक्त प्रा%ना पत्र रामकृ पाल सिंह एवं अरूण कु मार सिंह बावत पक्ष बनाये जाने स्वीकार दिकया जाता है, तद्नुार ंशो/न हो। चकबन्*ी अधि/कारी का आलोच्य आ*ेश दि*नांक 21.01.23 का प्रभाव एवं दि?यान्वन स्दिगत अदि@म आ*ेश तक दिकया जाता है। अवर न्यायालय की पत्रावली आहूत होकर वास्ते ुनवाई दि*नांक 04.02.25 को पेश हो।" 4. It appears from the order dated 21.01.2023, operation and implementation of the which has been stayed vide the impugned order dated 21.01.2025, that the concerned parties to the proceedings were not heard. For ready reference, the order dated 21.01.2023, is extracted herein under :- " आ*ेश अवलोकन दिकया गया। आ*ेश के दि?यान्वयन अंश की अंत े पूव% की चतु% लाइन में टंकण की त्रुदिटवश अंदिकत 'गाटा ं0 6/5 की *धिक्षणी मेड़' के स्ान पर शुद्ध रूप में 'गाटा ं० 05 की *धिक्षणी' मेड़ अंदिकत हो। शे3 आ*ेश यावत अंदिकत हो। यह आ*ेश पूव% पारिरत आ*ेश दि*नांक 20/1/2023 का अंश हो। पत्रावत्तिलत हो। ह०अ० 20/01/2023" 5. On being confronted, after taking note of the fact that the concerned parties were not heard on 21.01.2023 by Consolidation Officer (in short "C.O."), the learned counsel for the petitioner says that without interfering in the impugned order, the present writ petition be disposed of with a direction to the Deputy Director of Consolidation concerned to conclude the proceedings within the time stipulated by this Court. 6. The aforesaid has not been opposed. 7. In view of the aforesaid, without interfering in the impugned order dated 21.01.2025, the present writ petition is disposed of with a direction to the Deputy Director of Consolidation, Ayodhya to conclude the proceedings in issue within a period of four months from the date of production of copy of this order, if possible and if there is no other legal impediment, after giving opportunity of hearing to the parties to the litigation including the Narendra Dev Agricultural and Technical University, Kumarganj, Ayodhya as also the Gaon Sabha concerned.
