Heard learned counsel for the parties and perused the record. 2. The present petition has been filed by the petitioner with the following prayer :- "(i). Issue an order or direction in the appropriate Nature to thereby quashing/Setting aside the impugned order dated 13.08.2024 (Annexure No. 1) passed by Additional District Judge, Court No. 2, Barabanki in Misc. Civil Appeal No. 27 of 2022 'only to the extent to remitted the matter to the learned trial court to hear again on the observation given therein' and also directing the Appellate Court to allow the interim relief application No. 36-Ga of petitioner-plaintiff filed under order 39 rule 1 of CPC in the interest of justice." 3. Considering the aforesaid prayer, it is directed that the trial court shall endeavour to decide the aforesaid pending matters, with all expedition, preferably within a period of one year from the date of production of copy of this order. 4.
