(2) Applicant has sought transfer of Case No. 7/2022, filed by applicant’s wife and daughter under Section 125 CrPC seeking maintenance, from the Court of Principal Judge, Family Court, Rudrapur to Family Court, Nainital, on the ground that there is some threat to his life and three Criminal Miscellaneous Applications, under Section 482 CrPC, between the same parties are pending before the High Court at Nainital. (3) The ground taken for transfer of aforesaid maintenance application does not appear to be valid. Respondent (wife) is without any source of income. Transferring the maintenance application from Rudrapur to Nainital would result in great inconvenience to her. Applicant is a lawyer, who is practising at Mainpuri in Uttar Pradesh, therefore, Rudrapur would be nearer to his place of residence.
