( 2025:JHHC:17585 ) IN THE HIGH COURT OF JHARKHAND AT RANCHI B.A. No. 5341 of 2025 ------ Prabhakar Pandey @ Bittu Baba, aged about 21 years, Son of Basant Kumar Pandey, resident of village –Naudiha, P.O. – Loharsi, P.S. –Kunda, District –Chatra. … Petitioner Versus The State of Jharkhand … Opposite Party ------ CORAM: HON’BLE MR. JUSTICE ANIL KUMAR CHOUDHARY ------ For the Petitioner : Mr. Jitendra Shankar Singh, Advocate : Ms. Rajika Mahali, Advocate For the State : Mr. Bhola Nath Ojha, Spl. P.P. ------ Order No.02 Dated- 02.07.2025 Heard the parties. The petitioner has moved this Court for grant of bail in connection with NDPS P.S. Case No.32 of 2023 arising out of Kunda P.S. Case No. 49 of 2022 registered for the offences punishable under sections 15/18/20/22/25/27A/29 of the NDPS Act. The learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner is a habitual narcotics dealer and from the possession of the petitioner 34 Kg of Doda and 10 Kg of Ganja has been seized. It is then submitted that besides this case, the petitioner is also involved in three other cases involving the Narcotics Drugs and Psychotropic Substances Act. It is further submitted that the allegations against the petitioner are all false. It is next submitted that the petitioner has been in custody since 05.02.2025, as has been mentioned in paragraph no. 13 of the bail application. Hence, it is submitted that the petitioner be admitted to bail. The learned Spl. P.P. on the other hand vehemently opposes the prayer for bail and submits that keeping in view the criminal antecedents of the petitioner, there is every chance of the petitioner indulging in sale and purchase of narcotics again, if released on bail. It is next submitted that there is every chance of the petitioner absconding and tempering with the evidence, if released on bail. Hence, it is submitted that the petitioner ought not to be admitted to bail. Considering the serious nature of allegation against the petitioner and the huge quantity of Doda and Ganja seized as well as three criminal antecedents of similar nature against the petitioner, this Court is not inclined to admit the petitioner to bail at this stage. Accordingly, the prayer for bail of the above-named petitioner is rejected. (Anil Kumar Choudhary, J.) Sonu-Gunjan/
