The petitioners' apprehend illegal utilization of their bhumidhari land bearing Gata No.1780 situated in Village Sudesh Bahadurpur, Tehsil and District Unnao by the Public Works Department for construction or widening of a road. As of now, it is an apprehension, nevertheless, the official opposite parties shall ensure that the construction or widening of road, if any, takes place only on land permissible for it and the bhumidhari land of the petitioners is not utilized or encroached, unless it is compulsorily acquired or purchased as per law. It would be better if they conduct a survey to ascertain the land and its boundaries over which the construction is to take place. The Writ Petition stands disposed of. (Om Prakash Shukla,J.)
