Neutral Citation No. - 2025:AHC-LKO:27061 Court No. - 18 Case :- WRIT - A No. - 4769 of 2025 Petitioner :- Manju Devi Respondent :- State Of U.P. Thru. Prin. Secy.. Child Development And Nutrition Lko And 4 Others Counsel for Petitioner :- Ram Kumar Singh,Amit Kumar Singh Counsel for Respondent :- C.S.C. Hon'ble Karunesh Singh Pawar,J. Heard learned counsel for the petitioner and learned Standing Counsel for respondent nos.1 to 5. Learned standing counsel, on the basis of written instructions which are taken on record, has submitted that the petitioner was selected on the reserved post for OBC candidates. She was called for physical verification on 22.04.2025 however, she could not produce her caste certificate as uploaded on portal, therefore, she was given one week's time. Upon verification from online portal, her caste certificate was found to have been issued to one Ratan Kumari wife fo Ramesh Kumar Verma and not in the name of the petitioner. In view of above instructions, admittedly the petitioner has not uploaded her caste certificate and in view of Clause 3 च of paragraph 4 of the Government Order dated 21.03.2023, caste certificate issued by the tehsil only online digitally singed are applicable which can be verified online. Since the petitioner has not uploaded her caste certificate as required by the above Government Order, she has not been issued the appointment letter despite coming on the first position in the select list.
Learned counsel for the petitioner has relied on the judgment passed by a Co-ordinate Bench of this Court in Misc. Single
No.662 of 2013 (Yogendra Pratap vs. State of U.P. & others) whereby the inadvertent error of the petitioner has been overlooked by the court. Accordingly, the petitioner prays that she may be permitted to give a representation to the respondent No.4 and the same may be decided sympathetically. Learned standing counsel has no objection to this innocuous prayer. Considering the above, the petition is disposed of with liberty to the petitioner to move a representation to respondent no.4 i.e. District Program Officer within two weeks' from today. If the petitioner submits a fresh representation, the respondent no.4 shall decide the same within four weeks' thereafter, by passing a speaking and reasoned order.
