Also heard Mr. K. K. Das, learned Additional Public Prosecutor for the State of Assam. 2. This is an application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, in respect of Baisistha P. S. Case No.145/2025, whereby the Page No.# 2/3 petitioner Pranjal Kumar Dutta has prayed for releasing him on bail. 3. On the basis of a G.D. Entry No.140 dated 07.03.02025, an FIR was lodged by Jorabat Police out post, wherein it was alleged that a truck bearing registration No.As-28-C-9805 was coming from Meghalaya to Guwahati, which carrying Sawn Timbers, Police alleged that the driver of the vehicle could not show any document, thereafter the petitioner was arrested from his house. 4. The petitioner has submitted that he purchased Pine Timbers for his house, which was he was constructing at Kharguli locality at Guwahati. He paid a price of Rs.46,000/- for this purpose, he has got all the documents. 5. Moreover, the documents available in the record shows that the timbers were actually seized on 02.06.2025. 6. I have considered the submissions made by learned counsel for both the sides. 7. The petitioner has shown documents, which states that he had purchased Pine timber from Meghalaya to be used in his house at Kharguli. The forwarding report also shows that the timbers were suspected to be stolen properties but till now no FIR has been lodged to that effect. 8. Considering all these facts, this Court is of the opinion that the petitioner no longer deserves to be detained in custody. 9. The bail application of the petitioner is allowed. 10. The petitioner, Pranjal Kumar Dutta shall be released on bail of Rs.25,000/- Page No.# 3/3 with a surety of like amount to the satisfaction of the learned Chief Judicial Magistrate, Kamrup(Metro), Guwahati. 11.
