(2) Petitioners are employed with Primary Cooperative Societies and are serving as In-charge Secretary. The next promotional post available to the petitioners is that of Cadre Secretary. According to petitioners, there are as many as 76 post of Cadre Secretary in different cooperative societies within the State, out of which only 43 are filled and remaining 33 are lying vacant. By means of this writ petition, petitioners have sought the following reliefs: “a) Issue a issue a writ, order or direction in the nature of Certiorari to call for the record and to quash the impugned order dated 22.09.2023 passed by the respondent no. 2 contained in Letter No. 7524-29/PACS/Writ-Letter-2023-24 dated 22.09.2023, whereby, the claim of the petitioners for promotion from the post of ‘Mini Bank Incharge’ to the post of “Cadre Secretary” has been rejected. (Annexure No. 16) b) Issue a writ, order or direction in the nature of Mandamus directing the respondents to promote the petitioners from the post of ‘Mini Bank Incharge’ to the post of “Cadre Secretary” in the respondent department in District – Pithoragarh.” 2025:UHC:8904 (3) Learned State Counsel refers to the averment made in para 5 of the counter affidavit, filed by Additional District Cooperative Officer, Pithoragarh, and submits that there are 33 vacancies on the post of Cadre Secretary and charge of the said post has been handed over to other persons. (4) Having regard to the fact that sufficient number of post of Cadre Secretary are lying vacant in different cooperative societies, therefore writ petition is disposed of with a direction to Registrar, Cooperative Societies to examine the feasibility of holding promotion exercise for filling the available vacancies on the post of Cadre Secretary. If it is found that there is no legal impediment in supplying the available vacancies by promotion, then necessary promotion exercise shall be completed within four months from the date of production of certified copy of this order.
