The present petition was filed alleging that despite a partition suit pending, the respondent-Bank has obtained an order under Section 14 SARFAESI Act and is pressing the same for eviction in pursuance to the said order. 3. Today an statement has been made by the Counsel for the respondent no.5, Bank that the account has been closed and the amount payable to the Bank has been paid and the Bank no more pressing the order passed under Section 14 and no proceedings will be initiated against the petitioner or the borrower. 4. In view of the said statement, the present petition is disposed off quashing the order dated 19.03.2025 (Annexure-7).
