JUSTICE MITALI THAKURIA ORDER 24.07.2025 Heard Mr. A. A. Dewan, learned counsel for the petitioners. Also heard Mr. B. Sarma, learned Additional Public Prosecutor for the State respondent. This is an application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, praying for grant of pre-arrest bail to the accused/petitioners, who are apprehending arrest in connection with Barpeta Road P. S. Case No. 27/2025, under Sections 118(2)/109(1)/3(5) of BNS. The case diary as called for, has not yet been received. It is submitted by Mr. Dewan, learned counsel for the petitioners, that as per the instructions of his clients, the case has already been charge-sheeted and they have also received summons. Accordingly, a petition has been filed through their engaged counsel. He further submits that the petitioners will appear before the learned Trial Court by filing a regular bail application in that regard. Therefore, as per the instructions of his clients, he seeks permission to withdraw the instant petition. Considering the submissions made by the learned counsels for both sides, and in view of the fact that the charge sheet has been filed, as submitted by the learned counsel for the petitioners, the prayer is allowed.
