Neutral Citation No. - 2025:AHC-LKO:25311 Court No. - 18 Case :- WRIT - A No. - 4805 of 2025 Petitioner :- Nitu Sahu Respondent :- State Of U.P. Thru. Addl. Chief Secy. Child Development And Newtition Lko. And 5 Others Counsel for Petitioner :- Arjun Kumar Kaushal Counsel for Respondent :- C.S.C. Hon'ble Karunesh Singh Pawar,J. Heard learned counsel for the petitioner and the learned Standing Counsel for the respondents. Notice to respondent no. 6 is dispensed with in light of the proposed order. The present writ petition has been filed with the following prayers:
"i. Issue a Writ, order or direction in the nature of certiorari to quash the appointment of opposite party no.6 on the post of Aanganwadi Karyaktri of the village-Mirchiya, Block Sidhaur, District-Barabanki. ii. Issue a writ order or direction in the nature of mandamus thereby commanding and directing of opposite parties to issue appointment letter to the petitioner for the post of Aanganwadi Karyaktri of the village- Mirchiya, Block Sidhaur, District-Barabanki." Learned Standing Counsel, on the basis of written instructions, has submitted that one Neha was accorded first priority in the select list for the post of Anganwari Karyakatri on account of possessing a BPL certificate. The petitioner, belonging to the APL category, is placed at serial no. 7 in the merit list. It is thus contended that, in accordance with the Government
Order dated 21.03.2023, preference has rightly been given to the BPL category candidate as per clause 3(Ga)(ii) of the said Government Order, even over a more meritorious APL category candidate. There appears to be no illegality in the impugned order.
The writ petition, being devoid of merit, is accordingly dismissed. The instructions provided by the learned Standing Counsel are taken on record.
