Heard learned counsel for the parties and perused the record. 2. The present petition has been filed by the petitioner with the following prayer :- "(i). Issue a writ, order or direction in the nature of MANDAMUS thereby commanding the opp. Parties specially the opp. Party No. 2 to 4 to remove the illegal encroachment of the Opp. Party No. 6 and 7 from the land gata No- 348/0.0730 hectare which is recorded as CHAKMARG in the revenue record situated at village-Saray Hankar, Pargana-Birhar, Tehsil-Alapur, District-Amebdkar Nagar with immediate effect and take appropriate and strict action against him so that the petitioner could get justice." 3. Learned Standing Counsel based upon instructions states that the proceedings for removal of the unauthorized encroachment by another encroachers have already been instituted. 4. In view of the said statement, the present petition is disposed of with direction to conclude the proceedings within the time as prescribed in the statute i.e. 90 days.
