Vill.- Jaipur, Dumurya, P.O. + P.S.- Nirsa, District- Dhanbad, Jharkhand. … Petitioner - Versus - The State of Jharkhand … Opp. Party ------ CORAM: - HON’BLE MR. JUSTICE AMBUJ NATH ----- For the Petitioner : Mr. Wazid Ali, Advocate For the State : Mrs. Priya Shrestha, Spl.P.P. --- 02/18.07.2025 Heard the parties. The petitioner has been made accused in connection with S.T. Case No. 577/2024 arising out of Chirkunda (Galfarbadi) P.S. Case No. 136 of 2024, corresponding to M.C.A. No.2798 of 2024 for the offence registered under Section 302 of the Indian Penal Code, pending in the court of learned District & Additional Sessions Judge-XI, Dhanbad. Bail application of the petitioner was earlier rejected by this Court vide B.A. No.408 of 2025 by order dated 07.03.2025. On 23.05.2024, body of an unknown woman in injured condition was found near Galfarbari Basti. Later on, the injured succumbed to her injuries. It appears that on the basis of confession of this petitioner and co- accused Rabbani Ansari the mobile phone of the deceased was recovered. Learned counsel for the petitioner submitted that co-accused Rabbani Ansari has been granted bail by this Court vide B.A. No.10533 of 2024 by order dated 13.02.2025. It appears that while granting bail to co-accused Rabbani Ansari this fact that the mobile phone of the deceased was also recovered on his confession and that of the petitioner was not brought to the notice of the Court. It is evident that on the basis of confession of this petitioner mobile phone of the deceased was recovered. In view of the aforesaid facts, I am not inclined to release the petitioner, on bail. Accordingly, his prayer for bail stands rejected. (Ambuj Nath, J.) Jay/-
