Applicant- Naresh Semwal, who is in judicial custody in connection with Case Crime/FIR No. 25 of 2024, under Sections 80 (2) of Bhartiya Nyay Sanhita 2024, registered at Police Station Purola, District Uttarkashi, has sought his release on bail. 4. Heard learned counsel for the parties and perused the material available on record. 5. Learned counsel for the applicant submits that neither the applicant ever harassed the deceased for demand of dowry nor she was ever tortured for not able to conceive; after the marriage the deceased was regularly visiting her parental house and no complaint with regard to bad behaviour of the applicant was reported till lodging of the FIR; there is no direct evidence against the applicant to implicate him for the offence under Section 80(2) of the Bhartiya Nyaya Sanhita and the applicant is languishing in jail since 15.10.2024. 2025:UHC:3040 6. Considering the submission of learned counsel for the parties and without expressing any opinion as to the final merits of the case, this Court is of the view that the applicant deserves bail at this stage. 7. Accordingly the bail application is allowed. 8. Let the applicant be released on bail, on his executing personal bond and furnishing two reliable sureties, each of like amount, to the satisfaction of Court concerned.
