Learned counsel appearing for the petitioner fairly submits that, after the passing of the impugned order dated 24.06.2025, the learned trial court has recorded the statements of seven more witnesses. He submits that only four prosecution witnesses remain to be examined. 2. He further submits that, in view of the change in circumstances occasioned by recording of the statements of seven more witnesses, it would be appropriate for the appellant herein to move a fresh application for bail before the learned trial court. He, therefore, seeks leave of this Court to withdraw the instant appeal, with liberty to file a fresh application for bail before the learned trial court in view of the changed circumstances. 3. His tatement is taken on record. The appeal is dismissed as withdrawn, with liberty as prayed for. 4. Needless to say, in case a fresh application for bail is moved by the appellant before the learned trial court, the same shall be considered and decided by the learned trial court with reasonable dispatch. 5. Nothing stated by the learned trial court while disposing of the earlier bail application vide order dated 24.06.2025 shall prejudice the consideration of the fresh bail application, if any, moved by the appellant.
