GP FOR REVENUE The Court made the following order: The petitioner claims that she was assigned lands admeasuring Ac.0.30 cents in Sy.No.98/40 and an extent of Ac.0.23 cents in Sy.No.47/7 of Kusumapolavalasa Village, Polanki Mandal, Srikakulam District, and the respondents have mutated her name in the revenue records and issued pattadar passbooks in her favour respect of the subject lands. The copies of Form-B in respect of the subject lands were filed along with the writ petition. It is further case of the petitioner that, on 17.06.2020, the respondents without issuing any notice and without following due procedure contemplated under law, visited the lands of the petitioner and took measurements. On enquiry, the petitioner came to know that the respondents are trying to allot the subject lands for construction of Village Secretariat and making efforts to start construction of the said building. Aggrieved by the said action of respondents, the present writ petition is filed. 2. This Court, while ordering notice, on 23.06.2020, directed the respondents to maintain Status-quo obtaining as on that date for a period of four (04) weeks, and the same was extended until further orders. 3. On the other hand, the 4th respondent-District Panchayat Officer filed counter affidavit stating that total an extent of Ac.1.05 cents of land is available in Sy.No.98/40. Out of which, the petitioner was assigned only an extent of Ac.0.30 cents. The proposal of construction of village secretariat is being carried out in an extent of Ac.0.25 cents in the said survey number, without interfering with the possession of the land assigned in favour of the petitioner. The counter affidavit further states that the respondents are not interfering with the possession of the petitioner in respect of the land situated in Sy.No.47/7. 4. In view of the categorical assertion made in the counter affidavit, the present writ petition is disposed of as no further orders are necessary in terms of interim order, dated 23.06.2020. There shall be no order as to costs.
