Mr. Ashim Kumar Ganguly, Mr. Subhajit Chowdhury.
... For the State.
Learned advocates appear for the respective parties. Mr. Bari, learned advocate appearing for the petitioner has pointed out to the fact that at the time of filling-up of the form, the result of the petitioner in Master Degree course was declared. In that view of the fact, necessary modification is required to be made so far as paragraph 5 of this Court’s order dated May 2, 2025, is concerned. Let the existing paragraph 5 be treated as deleted and instead the following paragraph 5 be incorporated.
“5. The petitioner has applied for, in the pass category of post. Also that the petitioner has been subjected to the same examination as that for the
2 Honours category of incumbents, in the process. That has rendered her subject to no different standard of examination, vis-à-vis a higher degree holder”. In paragraph 8 of the said order, in the 14th line, the words “though result was not published then”, shall be treated as deleted. This order shall be treated as part and parcel of the previous order of this Court, dated May 2, 2025. Remaining portion thereof shall remain as it is.
