Anubhag-1 Lko. And 3 Others Counsel for Petitioner :- Vijay Kumar Tiwari,Km. Niharika Mishra Counsel for Respondent :- C.S.C. Hon'ble Karunesh Singh Pawar,J. Heard learned counsel for the petitioner as well as the learned Standing Counsel for the respondents.
Learned counsel for the petitioner submits that the petitioner was suspended by the impugned order and departmental proceedings are currently ongoing. However, no final decision has been taken so far. It is further submitted that the petitioner retired from service on 30.04.2025. Learned Standing Counsel, on the basis of instructions, submits that the charge sheet was issued after the petitioner’s suspension. The departmental inquiry has been conducted and the inquiry report has been submitted. A show cause notice was issued to the petitioner, and he submitted his reply on
21.04.2025. Learned Standing Counsel further submits that the competent authority will take a decision in the matter at the earliest. It is also contended that the petitioner has approached this Court only after retirement, though he could have approached any time. On consideration of the submissions advanced and perusal of the record, so also the fact that the disciplinary proceedings are at the final stage and the petitioner has already retired, the writ petition is disposed of without entering into the merits of the
case. The disciplinary authority, i.e., opposite party no. 1, is
directed to take a decision in the petitioner’s case and conclude the proceedings within one month from the date of receipt of a certified copy of this order. The decision shall be taken strictly in accordance with the relevant rules, keeping in view the fact that the petitioner has retired from service.
