Notice. Mr. L.N. Sharma, learned Additional Advocate General, appears and waives service of notice on behalf of the respondents.

With the consent of learned counsel for the parties, the matter is heard at this stage.

This writ petition has been filed for the grant of following substantive reliefs:-
“i. That a writ in the nature of certiorari may very kindly be issued and impugned order dated 22.11.2025, as contained in Annexure P-7, may kindly be quashed and set aside.

ii. That a writ in the nature of mandamus may kindly be issued thereby directing the respondents to grant benefit of Assured Career Progression Scheme in favour of the petitioner by ignoring the effect of enhancement allowed on account of implementation of 5th pay commission and due and admissible financial enhancement up gradation falling due in favour of the petitioner w.e.f. 2012 may kindly be allowed along with all consequential benefits of arrears and interest.”

Learned counsel for the petitioner submits that the order passed by the respondents on 22.11.2025 (Annexure P-7) is not in consonance with law as the case of the petitioner is otherwise covered by the decisions rendered in Sanjay Kumar Versus State of Himachal Pradesh & others2 and Inder Singh Thakur & Ors. Versus State of H.P. & Ors.3. Learned counsel further submits that the petitioner would be satisfied in case he is permitted to make a representation to the respondents/ competent authority for redressal of his grievances for conferment of Assured Career Progression Scheme in light of the aforesaid decisions and directions are issued to the said authority to decide the same within a fixed time schedule. Learned Additional Advocate General is not averse to this prayer.

Having regard to the afore-submissions, but without examining the merits of the matter and

notwithstanding Annexure P-7, this writ petition is
disposed of by permitting the petitioner to file a representation to the respondents/competent authority within two weeks from today, whereafter, the same shall be considered and decided by the said authority in accordance with law as well as taking into consideration the above judgments, within a period of six weeks thereafter. The decision so arrived at shall also be communicated to the petitioner.
The writ petition stands disposed of in the above terms, so also the pending miscellaneous application(s), if any.
