1. Heard learned counsel for the applicants and learned Standing Counsel.
2. This application under Section 12 of the Contempt of Courts Act has been filed alleging wilful disobedience of the
judgment and order dated 18.02.2025 passed on Writ-A No. 1969 of 2025.
3. Learned counsel for the applicants submits that the
order of writ Court has not been complied with in letter and spirit. It is further submitted that the issue relating to the counting of work charge services is still pending before the Hon'ble Supreme Court and, therefore, the respondents have wrongly rejected the claim of the applicants. It is, thus, submitted that the respondent may be summoned and punished accordingly.
4. Shri Ramswaroop, learned Standing Counsel, on the other hand, submits that the writ Court directed the respondent to take decision on the representation of the applicants, which has already been taken. It is, thus, submitted that no contempt is made out.
5. Considering the submissions of the learned counsel for the applicants, learned Standing Counsel and going through the order of the writ Court as well as other relevant documents, it is evident that the decision on the representation of the applicants has already been taken by the respondent in pursuance of the order of writ Court. In view of above, this Court is of the view that no contempt is made out.
6. The application, accordingly, stands dismissed.
7. However, it is always open to the applicants to ventilate their grievance, if any, before the appropriate forum.
