Neutral Citation No. - 2025:AHC-LKO:39430 Court No. - 14 Case :- CRIMINAL MISC ANTICIPATORY BAIL APPLICATION U/S 438 CR.P.C. No. - 464 of 2025 Applicant :- Shahanawaz Khan @ Annu Opposite Party :- State Of U.P. Thru. Add. Chief Secy. Home Lko. And 3 Others Counsel for Applicant :- Rajesh Kumar Srivastava Counsel for Opposite Party :- G.A.,Onkar Singh Hon'ble Karunesh Singh Pawar,J. Heard learned counsel the applicant, learned A.G.A. for the State and learned counsel for the complainant. The present application under Section 438 Cr.P.C./482 BNSS has been filed seeking anticipatory bail in FIR/Case Crime No. 792 of 2022, under Sections 452, 354(ka), 323, 325,506 IPC; Section 7/8 of POCSO Act; & Section 3(2)5A of SC/ST Act, P.S. Kotwali City, District Raebareli. In the prosecution case, it is alleged that on 05.10.2022 at about 10.00 pm, the applicant along with the two co- accused persons have gone into the house of the complainant and inflicted injuries on her as well as on her minor daughter.
Learned counsel for the applicant submits that the applicant is innocent. It is a case of false implication. He has not committed any offence as alleged in the prosecution story. Moreover, the applicant has no criminal antecedents. Learned A.G.A. as well as learned counsel for the complainant have opposed the anticipatory bail application. Perused the record. A perusal of the statement of the complainant as well as the injured shows the complicity of the applicant. The injury report of the injured Gita Devi shows that a traumatic swelling 4cm x 4cm present on left shoulder joint and x-ray was advised. In the x-ray report, fracture has been found. Hence, it does not appear to be a case of false implication. Further, the statement of the complainant and the victim are supported by the medical report.
In view of the above, no ground for grant of anticipatory bail is made out. Accordingly, the anticipatory bail application is rejected.
