The learned counsel for the petitioner submits that the petitioner is arraigned as an accused in Crime No.45 of 2025, on the file of Narasaraopet I Town Police Station, Palnadu District, for the alleged offence under Section 61(2), 353(2), 115(2), 308(5) read with 3(5) of the BNS and Section 67 of the IT Act, 2000-2008. 2. It is submitted that, even as per the allegation, the offence under Section 308(5) cannot be made out against the petitioner. It is further submitted that the petitioner cannot be charged with an offence under Section 308(5), as he was not present at the alleged scene of offence. The allegation that the petitioner has merely supported the other accused does not make the offences under Sections 61(2), 353(2), 115(2), 308(5) and Sections 67 of the IT Act, applicable. 3. Considering the same, the Station House Office, Narasaraopet I Town Police Station, Palnadu District, shall complete the investigation without taking any coercive steps against the petitioner in Crime No.45 of 2025, the SHO/Investigating Officer to complete their investigation and file the final report/charge sheet.
