Petitioner filed a partition suit, which is pending before 1st Assistant Collector/Sub-Divisional Magistrate, Nainital and is numbered as Revenue Suit No. 27/13 of 2021-22. Petitioner sought a direction to the court concerned to expedite hearing of the said suit. 5. Learned State Counsel, however, submits that all the defendants to the suit have not been served; he further submits that learned trial court has passed an interim order in favour of petitioner, which is still operative. 6. Having regard to the huge pendency of cases before 1st Assistant Collector, Nainital, this Court is not inclined to fix any timeline for deciding the suit. However, the writ petition is disposed of with a request to court concerned to make endeavour to decide Revenue Suit No. 27/13 of 2021-22 at an early date.
