Heard learned counsel for the petitioner and learned standing counsel for the State-respondent. Learned standing counsel on the basis of written instructions submits that one Pooja Srivastava has secured highest merit i.e. 18.285 marks under APL category. The petitioner is though having income certificate of BPL category however, the same was issued more than six months prior to the date of advertisement and, therefore, she has also been considered in the APL category and has secured 12.003 marks in merit which is lesser than the selected candidate and it is for this reason she could not be selected. Perused the record so also the written instructions which are taken on record and the relevant Government Order dated 21.03.2023 and considering the fact that both the candidates have been considered under APL category and selected candidate has outperformed the petitioner and thus, this Court is not inclined to interfere in the matter.
