ORAL JUDGMENT (PER: HON'BLE THE CHIEF JUSTICE MR. JUSTICE N. V. ANJARIA) Heard learned advocate Mr. Kulkarni Malhar for the complainant. 2. Learned Single Judge, while allowing the writ petition by the judgment and order dated 23.01.2024 set aside the communication dated 02.11.2023 issued by the Secretary, Backward Classes Welfare Department and the Tender Notification dated 05.12.2023 calling for Expression of Interest. 2.1 Thereafter, learned Single Judge observed thus,
"The 2nd respondent is reserved liberty to notify fresh Expression of Interest strictly in consonance with the Rules and Government Order dated 14-10-2008 without brooking any delay.
While so doing he shall bear in mind the observation made in the course of the order."
2.2 In other words, respondent No.2 was given liberty to notify fresh Expression of Interest in accordance with the Rules and the Government Order dated 14.10.2008 without delay. - 4 -

3. It is against the aforesaid direction that the present petition is filed. 3.1 It has to be observed that in the direction of learned Single Judge, liberty was reserved for the competent authority to notify fresh Expression of Interest. It is only in the nature of liberty, which could not be construed as direction. Even otherwise, the complainant does not have any right to enforce that the authority notifies the fresh Expression of Interest. 4. Any directions in the judgment and order of learned Single Judge do not qualify to be tried in the contempt jurisdiction. 5. The contempt petition is misconceived and accordingly, it is dismissed.
