JUSTICE ANIL KUMAR CHOUDHARY By the Court:- Heard the parties. 2. No one turns up on behalf of the respondent No.5 in spite of repeated calls. 3. This Writ Petition has been filed under Article 226 of the Constitution of India with a prayer for issuance of appropriate writ/order/direction restraining the respondent authorities from dispossessing the petitioner and his (2025:JHHC:21082) 2 W.P.(C) No.4412 of 2011 family members from the land, the description of which has been made in this Writ Petition. 4. Learned counsel for the petitioner submits that the said prayer of the petitioner has become infructuous, hence, the petitioner is not pressing the said prayer. 5. Accordingly, the said prayer of the petitioner is rejected as not pressed. 6. Learned counsel for the petitioner further submits that the land of the petitioner was acquired by the respondent authorities but no payment of compensation was made in respect of the acquisition of the aforesaid land and similarly situated land owners approached this Court in W.P. (C) No.7346 of 2011 as well as W.P. (C) No.3404 of 2011 along with other allied Writ Petitions, the said Writ Petitions were disposed of vide order dated 23.03.2012 and the common order dated 04.02.2020 respectively giving liberty to the petitioners of those Writ Petitions to file representations before the authorities. Hence, it is submitted that this Writ Petition be disposed of with giving similar liberty to the petitioner as well. 7. Learned counsel for the respondent- State has no objection to the prayer of the petitioner and submits that if such representation is filed before the respondent No.3, the same shall be considered in accordance with law. 8. Considering the facts and circumstances of the case as well as the submissions made by the parties, this Writ Petition is disposed of with liberty to the petitioner to file a representation along with a copy of this order to the respondent No.3- Deputy Commissioner, Bokaro within a period of four weeks from today and if such representation is made then the respondent No.3- (2025:JHHC:21082) 3 W.P.(C) No.4412 of 2011 Deputy Commissioner, Bokaro is directed to consider the same or refer the matter to the competent authority, who deals with the land acquisition matters; as the case may be. The respondent No.3 or the officer to whom the representations are referred by the respondent No.3, shall pass appropriate orders in accordance with law within a period of three months from the date of receipt of the representation of the Writ Petitioner. 9.
