By means of this petition, the petitioner seeks the following reliefs: "a. issue writ, order or direction in the nature of Certiorari for quashing the order dated 22.02.2025 passed by opposite party no.3, as contained in Annexure No.1 to this writ petition. b. issue writ, order or direction in the nature of Mandamus thereby directing the opposite parties to transfer the petitioner from Police Station-Palia Kala, District- Kheri to Commissionerate Ghaziabad, District-Ghaziabad, in the interest of justice." Learned counsel for the petitioner contends that the petitioner’s representation has been decided arbitrarily, without due consideration of the illnesses she is suffering from. Perused the record, so also the impugned order contained in Annexure No. 1 to the writ petition, which is a detailed and reasoned order. The relevant part of the order is extracted below:- 5-रिट याचिका संख्याः ए-1234/2025 महिला आक्षी 212431305 कोमल शमा बनाग उ०प्र० ाज्य व अन्य में मा० उच्च न्यायालय, लखनऊ खण्डपीठ द्वाा पारित आदेश हिदनांक: 20.01.2025 के अनुपालन में याी महिला आक्षी 212431395 कोमल शमा के प्रत्यावेदन से सम्बन्ध में प्रकण से सम्बन्धिन्धत समस्त तथ्य एवं अभि8लेखों का गनतापूवक पीक्षण हिकया गया। पीक्षनोपान्त उत्तुन्धिस्=चित हिनम्नवत ै- (1) ग्रीष्मकालीन स्=ानान्तण सत्र 2024 के अन्तगत इस मुख्यालय पत्र संख्या डीजी-पा-त्=ा०-ग्रीष्मकालीन स्=ा० ना०पु०/2024/430 हिदनाक 28-03-2024 के शीर्षक अनुकम्पा के आधा प स्=ानान्तण में स्पष्ट रूप से अंहिकत ै हिक "अनुकम्पा के आधा प स्=ानान्तण पुलिलस कमH का अचिधका औ हिव8ाग के लिलए बाध्यकाी नीं ोगा क्योंहिक ऐसा कते समय 8ी शासकीय/हिव8ागीय हित को वीयता हिदया जाना आवश्यक ोगा।" (2) उ०प्र० पुलिलस की वेबसाइट प नाहिमनल ोल सिसस्टम प प्रदर्शिशत सेवा हिववण के अनुसा याी महिला आक्षी 212431395 कोमल शमा की 8तH चितभि= 03.06.2021 ै त=ा उक्त आक्षी का गृ जनपद बेली ै। (3) वतमान में "पुलिलस स्=ापना बोड" द्वाा जनपदों में हिवद्यमान रिहिUयों एवं कानून व्यवस्=ा के दृहिष्टगत सामान्य प्रकणों में अनुकन्या के आधा प वर्ष 2017 बै तक के ी 8तH आचिक्षयों के स्=ानान्तण के संबंध में हिवा हिकया जा ी ै। हिकन्तु वर्ष 2017 के बाद 8तH ऐसे उपहिनीक्षक/आक्षीगण जो दोनो ी (पचित पत्नी) उ०प्र० पुलिलस हिव8ाग में हिनयुक्त ैं उनके 8ी अनुकम्पा के आधा प स्=ानान्तण प हिवा हिकया जा ा ै। (4) याी महिला आक्षी 212431395 कोमल शमा वर्ष 2021 बै की 8ती महिला आक्षी ै। याी का प्रकण "पुलिलस स्=ापना बोड" द्वाा हिनधारित मानक के अनुरूप न ोने के काण याी महिला आक्षी 212431395 कोमल शमा का वतमान में अनुकम्पा के आधा प स्=ानान्तण हिकये जाने में नीचितगत बाधा ै। 6- रिट याचिका संख्याः ए-1234/2025 महिला आक्षी 212431395 कोमल शमा बनाम उ०प्र० ाज्य व अन्य में मा० उच्च न्यायालय, लखनऊ खण्डपीठ द्वाा पारित आदेश हिदनांक: 29.01.2025 के अनुपालन में याी महिला आक्षी 212431395 कोमल शमा के प्रत्यावेदन प सम्यक हिवा हिकया गया। हिवाोंपान्त याी गहिला आक्षी 212431395 कोमल शमा द्वाा हिकया गया अनुोध स्वीका योग्य नीं पाया गया। 7- उक्त के अचितरिक्त य 8ी अवगत काना ै हिक माननीय सवZच्च न्यायालय द्वाा स्=ानान्तण के सम्बन्ध में हिनम्न आदेश पारित हिकये गये ै, सिजसका हिववण हिनम्नवत् ैः- SLP No. 36717/2017 NAMRATA VERMA VS THE STATE OF UTTAR PRADESH & OTHERS on 6 September, 2021 It is not for the employee to insist to transfer him/her and for not to transfer him/her at a particular place. It is for the employer to transfer an employee considering the requirement. 8- मा० उच्च न्यायालय, लखनऊ खण्डपीठ द्वाा पारित आदेश हिदनांक: 29.01.2025 के अनुपालन में रिट याचिका में एनेक्ज-01 के रूप में संलग्न याी महिला आक्षी 212431305 कोगल शमा के प्रत्यावेदन हिदनांक 20.11.2024 को एतद् द्वाा अस्वीका कते ुए हिनस्तारित हिकया जाता ै।" A perusal of the impugned order shows that the petitioner was appointed on 03.06.2021 and her home District is Bareilly. As per the prevailing norms, only those officers/employees who were recruited up to the 2017 batch are being considered for postings on compassionate grounds. Post- 2017 recruits are considered only if both husband and wife are employed in the department. Since the petitioner is a relatively recent recruit, her case has not been found fit for consideration for posting at the location of her choice. The petitioner has also failed to demonstrate the nature of the specific illness which cannot be treated at her current place of posting, nor is there any specific pleading to this effect in the writ petition. I find no illegality in the impugned order. The writ petition, being devoid of merit, is accordingly dismissed. Order Date :- 29.4.2025 R.C.
