We have heard learned counsel for the petitioner and Sri Kuldeep Srivastava alongwith Sri Zoib Hasan and Sri Ankush Kumar Prajapati, Advocates appearing for the Respondent. Sri Pankaj Shukla, Advocate has appeared on behalf of Mr. Lauleen Kaur Bhalla and he has stated that he intends to file an intervention application. However, a preliminary objection has been raised regarding maintainability of this Petition by Sri Kuldeep Srivastava and he has relied upon a judgement of a Coordinate Bench of this Court in Criminal Misc. Writ Petition No. 6884 of 2024, 'Mohd. Wajid Vs. Union of India and Others', decided on 22.01.2025 Neutral Citation No: 2025:AHC-LKO:4122-DB wherein this Court has decided a similar issue regarding maintainability of the petition before this Court at Lucknow. Learned counsel for the petitioner has fairly stated that we have gone through the judgement and he prays that this writ petition be dismissed as withdrawn with liberty to file a fresh before the appropriate forum. Accordingly, this writ petition is dismissed as withdrawn with liberty to file a fresh before the appropriate forum.
