2. By means of this writ petition, petitioner has sought the following reliefs:
“(i) A writ, order or direction in the nature of mandamus commanding the respondents to give effect the judgment and order dated 06.01.2023 and judgment and order dated 29.07.2024 passed by settlement officer consolidation in accordance with law and deliver the possession to him over the plot chak no. 338 including khasra no. 553 & 554 by doing the paymish over the spot in pursuance to the
judgment and
order dated 06.01.2023 and judgment and order dated 29.07.2024 (Annexure No. 1 & 3 to this writ petition).
(ii) A writ, order or direction in the nature of mandamus commanding the respondent no. 1 to take a decisions on the application dated 02.12.2024 (Annexure No. 7 to this writ petition).
(iii) A writ, order or direction in the nature of mandamus commanding the respondent no. 2 to give effect to the
order dated 26.10.2024 (Annexure No. 6 to this writ petition).”

Learned counsel for the petitioner submits that petitioner’s Appeal was allowed by Settlement Officer, Consolidation vide
judgment dated 06.01.2023 and the Chak allotted to petitioner was amended; a review application was filed before the Appellate Authority, which was dismissed vide
order dated 29.07.2024 and the order passed by Settlement Officer,
2025:UHC:205 Consolidation has become final; but, benefit of the same has not been given to petitioner and he is yet to be handed over possession of the Chak allotted by the Appellate Authority.
4. Learned State Counsel submits that since petitioner has moved an application on 02.12.2024 to respondent no.1, therefore, he may be directed to take decision thereupon, within six months’.
5. The writ petition is, accordingly,
disposed of with a direction to Collector/ Deputy Director Consolidation, Haridwar to consider & decide the application made by petitioner on 02.12.2024 (contained in Annexure No.7 to the writ petition), within six months’ from the date of production of certified copy of this order. It goes without saying that opportunity of hearing shall also be given to other persons having interest in allotment of Chak.
