Applicant- Pushpendra Kumar Sharma, who is in Judicial custody in connection with Case Crime/FIR No. 13 of 2023, under Sections 409, 420, 467, 468 and 471 IPC, registered at Police Station Gadarpur, District Udham Singh Nagar, has sought his release on bail. 4. Heard learned counsel for the parties and perused the material available on record. 5. Learned counsel for the applicant submits that the applicant is in judicial custody since 20th June, 2023; the FIR was lodged under Section 409 and 420 IPC. The applicant was serving as T.G.2 in Uttarakhand Power Corporation Ltd. and was posted at Gadarpur; all the offences levelled against him are triable by Magistrate. He further submits that only 4 prosecution witnesses have been examined till today and as per the counter affidavit of the respondents there are total 10 prosecution witnesses to be examined. 6. Considering the submission of 2025:UHC:4044 learned counsel for the parties and without expressing any opinion as to the final merits of the case, this Court is of the view that applicant deserves bail at this stage. 7. Accordingly the bail application is allowed. 8. Let the applicant be released on bail, on his executing personal bond and furnishing two reliable sureties, each of like amount, to the satisfaction of Court concerned.
