Neutral Citation No. - 2025:AHC-LKO:24754 Court No. - 18 Case :- WRIT - A No. - 4653 of 2025 Petitioner :- Rambha Kumari Respondent :- State Of U.P. Thru. Prin. Secy. Deptt. Of Panchayati Raj U.P. Lko. And 5 Others Counsel for Petitioner :- Jagroopan Nishad,Pramod Kumar Counsel for Respondent :- C.S.C. Hon'ble Karunesh Singh Pawar,J.
1. Heard learned counsel for the petitioner and learned Standing counsel for the respondent State.
2. Through this petition the petitioner has approached this Court for issuance of a writ in the nature of Mandamus commanding the opposite parties to consider the case of the petitioner for selection and appointment on the post of Aganbadi Karyakatri taking into consideration the income certificate issued by the Tehsil Authorities on 9.4.2025.
3. Learned Standing Counsel has raised preliminary objection and submitted that pursuant to the Government order, the selection and appointment to the post of Aganbadi Karyakatri have been done after advertising the said post, however, the petitioner has not filled the form with requisite document. He further submits that earlier she was issued income certificate dated 10.10.2024 according to which she was APL candidate. Now the petitioner has filled up her form on 22.12.2024 as a BPL candidate.
4. In rebuttal, learned counsel for the petitioner submits that on the basis of income certificate dated 10.10.2024 petitioner's case was not considered for selection on the post of Aganbadi Karyakatri. Afterwards, vide Annexure-4 another income certificate dated 9.4.2025 was issued to the petitioner showing her as BPL candidate.
5. Submission of learned Standing counsel is that income certificate dated 9.4.2024 has been issued after the date of application given by the petitioner i.e.
22.12.2024.
6. Considering the above and in terms of the Government Order, the income certificate should have been issued six months before the date of the advertisement. The date of the income certificate must precede the date of the application i.e. 22.12.2024, thus, income certificate issued on subsequent date i.e. 9.4.2025 cannot be considered.
7. The writ petition is utterly misconceived and is accordingly dismissed. Order Date :- 29.4.2025 Madhu D.R/P.S Digitally signed by :- MADHU KUMARI High Court of Judicature at Allahabad, Lucknow Bench
