Court No.10 And Anr. Counsel for Petitioner :- Manoj Kumar,Sridhar Awasthi Counsel for Respondent :- Ravi Shanker Tewari,Brijesh Kumar,Rakshit Raj Singh,Utkarsh Srivastava Hon'ble Pankaj Bhatia,J.
1. Heard learned counsel for the petitioner, Sri Shreyash Shukla, Advocate holding brief of Sri Ravi Shanker Tewari, learned counsel for the respondent and perused the record.
2. The present petition has been filed by the petitioner challenging an order dated 28.01.2020, whereby the application for interrogatories was rejected.
3. The petitioner is a tenant and in a case filed by the respondent under Section 21(1)(a) of the U.P. Act No. XIII of 1972, opposed the plea and took a ground that the bonafide need established was not proper. An application for interrogatories was moved during the pendency of the proceedings praying that the respondent to disclose his position and rank and salary package. The said application has been rejected by means of the impugned
order.
4. Considering the fact that the order impugned is interlocutory in nature, I do not see any reason to interfere. The petitioner would be at liberty to take all the ground when the appeal is preferred including the challenge to the order impugned herein, if the need so arises.
5. The petition is disposed of in terms of the above.
