Neutral Citation No. - 2025:AHC-LKO:24975 Court No. - 13 Case :- CRIMINAL MISC ANTICIPATORY BAIL APPLICATION U/S 438 CR.P.C. No. - 459 of 2025 Applicant :- Pankaj Singh @ Raghvendra Pratap Singh Opposite Party :- State Of U.P. Thru. Prin. Secy. Home Deptt. Lko. And Another Counsel for Applicant :- Ashok Kumar Singh,Ashish Kumar Tiwari Counsel for Opposite Party :- G.A. Hon'ble Manish Mathur,J.
1. Heard learned counsel for the applicant and learned Additional Government Advocate appearing on behalf of opposite party no.1. 2. In view of order being passed, notices to opposite party no.2 stand dispensed with. 3. First Anticipatory Bail Application has been filed with regard to Case Crime no.351 of 2019 under Sections 419, 420 I.P.C. and Section 136(1) C of Indian Electricity (Amended) Act, 2003, P.S. Pasgawan, District Lakhimpur Kheri. 4. As per contents of F.I.R., the incident is said to have taken place on 15.06.2019 when upon information being received, a team from Electricity Department with cooperation of local police is said to have raided various places and found illegal installations of transformers at various places without authorization. Applicant is named as one of the contractors involved in the said installations. 5. Learned counsel for applicant submits that applicant has been falsely implicated in allegations levelled against him which would be evident from fact that while filing of charge sheet, Junior Engineer concerned has not been named therein. It is submitted that punishment with regard to all the Sections is less than seven years and submits that applicant has already been granted interim anticipatory bail by this Court in connected Case Crime No.375 of 2019 in Anticipatory Bail Application no.306 of 2025. It is submitted that applicant has cooperated during course of investigation. 6. Learned Additional Government Advocate has opposed the bail application with submission that contents of F.I.R. clearly indicate complicity of not only applicant but of various persons including employees of the Electricity Department who were involved in the illegal installations of transformers. He has further submitted that co-accused Mohd. Tayyab and co-accused Aditya Gupta being on a similar footing have been denied anticipatory bail by this Court vide Anticipatory Bail Applications numbered 886 of 2023 and 884 of
2023. It is next submitted that warrants have also been issued against applicant. 7.
Considering the submissions advanced by learned counsel for the parties and upon perusal of material on record, it appears from
a perusal of F.I.R. that applicant has been named therein as one of the contractors against whom allegations have been levelled. Anticipatory Bail Applications of co-accused on a similar footing have already been rejected as indicated herein above. It also appears that applicant has not cooperated during course of trial due to which warrants were issued against him. 8. In such situation, this Court does not find any good ground to grant indulgence in the matter. However, applicant is granted liberty to seek regular bail. 9. Anticipatory Bail Application is accordingly dismissed.
