Today when the petition is taken up for hearing, learned Assistant Public Prosecutor has produced a copy of instructions of the Inspector of Police, Kasibugga Police Station, Srikakulam District wherein it is stated that after due investigation, the Police have filed a charge sheet on 26.06.2021 vide SC.No.35 of 2021 and the same is pending for trial. 3. In view of the fact that a charge sheet vide SC.No.35 of 2021 has already been filed on 26.06.2021, pending the present petition, learned counsel for the petitioner sought permission of this Court to withdraw the present petition. 4. Permission as sought for is accorded. Accordingly, this criminal petition is dismissed as withdrawn, with a liberty to challenge the aforementioned charge sheet, if at all aggrieved by the same.
